IN-light is a trademark of PainControl Centre BV, KvK no. 64754510 with address: Hengelosestraat 500, Enschede, The Netherlands, and sells treatment products to individuals in Europe (“Customer”), through the website www.in-light.shop. Customers in various European countries are supplied through this website.
Agreement
● These purchase conditions apply when a customer enters into a contract with IN-light for any of the products supplied by IN-light. To enter into a contract with IN-light, the customer must be at least 18 years old.
● To place an order through the website, the customer must enter their information on the website. The customer is responsible for entering correct account information, name and email, as well as correct delivery information, such as delivery address, delivery date.
● After the customer completes the order, IN-light will confirm the customer's order. When IN-light finally confirms by email with an order confirmation, the order is completed and the agreement is closed.
● IN-light requests the customer to keep the order confirmation for any contact with IN-light's customer service. IN-light reserves the right to modify or cancel the customer's confirmed order until the final order is delivered.
● By entering into the agreement as set forth above, the customer acknowledges and agrees to be bound by these terms and conditions. At the same time, the customer confirms that he has taken note of the information on the processing of his personal data, as set out in the section on personal data below.
Purchase and payment
Pricing
All current prices and fees are presented in the IN-light price list on the website, which is valid at all times. IN-light reserves the right to adjust prices at any time. However, neither price reductions nor price increases will affect any order confirmed by IN-light. The prices on the website include VAT.
Payment
● Payment is easy and secure through the payment provider Mollie where you can choose different payment options. You don't need to have an account with Mollie to pay. Complete the purchase directly with iDeal, credit card, PayPal and more. Mollie maintains high security standards and uses 3D secure technology for all card payments.
● The payment options offered to the customer are those available on the website at the time the customer places the order. The applicable payment terms are those indicated at the time of the order and may vary depending on the product and/or service ordered by the customer and the payment method chosen by the customer.
● For business purchases on invoice, IN-light follows the rule that delivery will only be made upon receipt of 100% of the payment.
Delivery
● Delivery will take place within 2-3 business days provided the product is in stock. Shipping costs are included in the listed prices.
● Your shipment will be delivered to the delivery address you provide, or you will receive a message that the package can be picked up at the nearest delivery point of IN-light's chosen carrier. You will receive the details for this from our Fulfillment company Cubuso BV.
● If you do not pick up your package at the pickup point, it will be returned to us. The same applies if you entered a wrong address.
● If you do not pick up the package, we will charge €19.50. These costs are for shipping and handling and will be deducted from your refund. Therefore, always remember to pick up your orders within a few days of the arrival of your package at the pickup point.
Warranty
Our products are made from premium materials and with advanced technology. They are thoroughly tested so that we can be sure they will perform flawlessly for their intended purpose. However, it is possible that products may have a material or manufacturing defect. It is of utmost importance to us to receive feedback on defective products as soon as possible so that we can take further action. For warranty issues, please contact our customer service department within 30 days of discovery. IN-light offers a 1-year warranty on the following products: IN-light Pro. The warranty covers defects in materials and workmanship and not defects caused by yourself.
Consumer data
The customer confirms that the personal information provided by them as part of the order has been entered correctly and completely and is responsible for any incorrect information. IN-light cares about your privacy and we want you to feel comfortable providing your information to us. IN-light is responsible for processing the personal data provided by the customer in connection with the order. For information on how IN-light processes customer personal data, please refer to IN-light's privacy policy.
● IN-light reserves the right to make typographical errors on the website, including prices, as well as in descriptions in the form of images, videos, writings or any other form, for all products ordered by the customer through the website, as well as technical errors.
● IN-light shall be entitled to assign all or part of its rights and obligations under this agreement to a third party under the same terms and conditions.
● Customer shall only be entitled to assign its rights and obligations under the agreement upon IN-light's written consent.
● All intellectual property rights and technical solutions related to the products and services and the website shall belong to IN-light or a third party with which IN-light cooperates. IN-light and its affiliates retain all intellectual property rights in all information provided to Customer in connection with the Agreement and Customer's use of the Products, as well as in all other published materials, trademarks, logos, images, videos, databases, etc., as well as in all other intellectual property rights. Such materials described in this paragraph may not be used by Customer without IN-light's written permission, unless Customer's use is necessary for Customer's use of the products and/or services under these terms and conditions.
● IN-light has the right to correct such errors and to change or update the information at any time without notice to the customer. If an incorrect price is quoted for a product or service ordered by the customer, IN-light will notify the customer via email and wait for the customer's approval of the corrected price or quantity until the customer's order is shipped. In the event that approval is not received in a timely manner, IN-light has the right to remove the product or service from the customer's order and credit the customer for its value.
Disputes
These terms and conditions are governed by Dutch law and disputes will be settled by a Dutch court. Consumers can also appeal to the complaints committee of the Dutch Arbitration Board (ARN).
